Terms of Service

Welcome to Murkaverse. These Terms of Service ("Terms") govern your use of the Murkaverse mobile application, the Murkaverse web trial, and any related services we provide (together, the "Service"). The Service is operated by Dreamwarden OÜ ("we," "our," or "us"), a company registered in Estonia.

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you accept these Terms and agree to comply with them. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

These Terms apply alongside any platform-specific terms that govern the way you access the Service, including Apple's standard end-user licence agreement (which applies to use of the Service on iOS) and Google Play's terms (which apply to use of the Service on Android).

2. The Service

Murkaverse is an AI-powered dream interpretation service. The Service includes:

• AI dream interpretation, available through guided conversation with Murka, our AI dream companion, grounded in psychology and global symbolic tradition.
• The Dream Calendar, where you can record dreams and build a personal archive over time.
• Dreamdust, an in-app currency that powers your use of the Service and unlocks additional features.
• The Murkaverse web trial, which offers limited access to the Service through a web browser.
• Educational content, including blog posts, written by the Murkaverse team.

We may add, modify, or remove features at any time. Where a change materially affects your use of the Service, we will provide reasonable notice.

3. Eligibility and Accounts

3.1 Age Requirement

The Service is intended for users aged 18 and over. By creating an account or otherwise using the Service, you confirm that you are at least 18 years old.

3.2 Account Registration

To access most features, you will need to create an account. When you do, you agree to:

• Provide accurate, current, and complete information.
• Keep your account credentials confidential.
• Accept responsibility for all activity that takes place under your account.
• Notify us promptly if you believe your account has been accessed without your permission.

We may refuse, suspend, or close accounts at our discretion where these Terms have been breached or where required by law.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in line with these Terms. You agree not to:

• Submit content that is illegal, harmful, threatening, abusive, defamatory, or that infringes the rights of others.
• Submit content about other identifiable individuals in a way that violates their privacy.
• Attempt to reverse engineer, decompile, or extract source code from the app or any part of the Service, except to the extent expressly permitted by law.
• Use the Service to send spam or unsolicited messages, or to harass any person.
• Attempt to circumvent usage limits, security features, or access restrictions.
• Use automated tools (bots, scrapers, etc.) to access the Service without our written permission.
• Use the Service to develop a competing product or to train a competing AI model.

We may remove content or restrict access where we believe these rules have been broken.

5. Dream Content and Licence

5.1 Your Content

You retain ownership of the dreams, conversations, and other content you create or submit through the Service ("Your Content").

5.2 Licence You Grant Us

So that we can operate the Service for you, you grant Dreamwarden OÜ a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display back to you, and otherwise process Your Content for the following limited purposes:

• Providing the Service to you, including transmitting Your Content to OpenAI, accessed via OpenRouter, so that interpretations can be generated.
• Maintaining your private archive in the Dream Calendar.
• Improving the Service, using only anonymised and de-identified versions of Your Content, as described in our Privacy Policy.
• Complying with legal obligations.

This licence ends when you delete the relevant content or your account, except where retention is required by law or for legitimate backup and security purposes.

5.3 Sensitive Material

You understand that dream content may include personal, emotional, or sensitive details. We handle Your Content as described in our Privacy Policy.

6. Interpretations and Disclaimers

Dream interpretations provided through the Service are generated by artificial intelligence and are intended for self-reflection, exploration, and entertainment. By using the Service, you acknowledge that:

• Interpretations provided through the Service are not professional psychological, medical, psychiatric, or therapeutic advice and are not a substitute for consultation with a qualified professional.
• The meaning of a dream is personal and subjective. We do not guarantee the accuracy, completeness, or usefulness of any interpretation.
• AI can make mistakes, including factual errors, omissions, and responses that do not capture the full context of what you shared.
• If you are concerned about your mental health, please speak to a qualified professional or, in an emergency, contact your local emergency services.

7. Subscriptions, Dreamdust, and Purchases

7.1 Free Access

The Service is free to start. Every user receives a daily allowance of messages that refreshes automatically, plus a starter Dreamdust bonus on first use.

7.2 Subscriptions

A Murkaverse subscription extends your use of the Service beyond the daily free allowance and unlocks additional features as they are released. Subscriptions are offered through the Apple App Store and Google Play and are billed through your Apple or Google account.

Unless cancelled, subscriptions automatically renew at the end of each billing period at the then-current price. You can view, manage, and cancel your subscription at any time through your Apple ID or Google account settings. Cancellation takes effect at the end of the current billing period.

7.3 Dreamdust Top-Ups

Dreamdust is the in-app currency used to power your use of the Service and to unlock additional features. You can purchase one-off Dreamdust top-ups in addition to your subscription. Top-ups are processed through the Apple App Store or Google Play.

Dreamdust has no monetary value outside the Service. It is non-transferable, non-exchangeable for cash, and cannot be redeemed for any third-party product. We may adjust the rate at which Dreamdust is consumed by features of the Service, but we will give reasonable notice before doing so in a way that materially affects existing balances.

7.4 Refunds

Refunds for subscriptions and Dreamdust top-ups are handled by Apple and Google according to their respective policies. To request a refund, please use the refund process provided by the platform where you made the purchase. We do not process refunds directly.

7.5 EU Right of Withdrawal

If you are a consumer in the European Union, you would ordinarily have a 14-day right to withdraw from a purchase of digital content. However, by purchasing a subscription or Dreamdust top-up and immediately using the Service (for example, by starting a conversation or spending Dreamdust), you expressly request immediate performance and acknowledge that you lose the right of withdrawal once performance has begun, in accordance with Article 16(m) of the EU Consumer Rights Directive (Directive 2011/83/EU).

7.6 Price Changes

We may change the price of subscriptions or Dreamdust from time to time. Any price change to your existing subscription will be communicated in advance, and you will have the opportunity to cancel before the new price takes effect.

7.7 Account Termination and Unused Balances

If you close your account, or if we terminate your account for breach of these Terms, any unused Dreamdust or remaining subscription period is forfeited and is not refundable, except where required by applicable consumer protection law.

8. Service Availability and Updates

We work to provide a reliable Service, but you acknowledge that:

• The Service may be temporarily unavailable due to maintenance, updates, or technical issues.
• We may release updates to the app, and some updates may be required in order to continue using the Service.
• We may modify, suspend, or discontinue features at our discretion. Where a change materially reduces what you have already paid for, we will offer a reasonable remedy.
• We may apply usage limits, including daily message limits and rate limits, to maintain fair access for all users.

9. Intellectual Property

9.1 Our Rights

The Service, including its software, design, branding, content, and underlying technology, is owned by Dreamwarden OÜ or our licensors and is protected by copyright, trademark, and other intellectual property laws.

"Murkaverse," "Murka," "Dreamdust," and related names and logos are trademarks of Dreamwarden OÜ.

Except for the rights expressly granted to you in these Terms, no rights in the Service are transferred to you. You may not copy, modify, distribute, sell, or create derivative works of the Service or any part of it, except as permitted by applicable law.

9.2 Feedback

If you send us suggestions, feedback, or ideas about the Service, you grant us a perpetual, royalty-free, worldwide licence to use them without obligation to you.

10. Third-Party Services

The Service relies on third-party providers, including AI providers, hosting providers, and the Apple App Store and Google Play. Their handling of your data and your relationship with them are governed by their own terms and privacy policies. Specifically, your dream entries and chat messages are shared with OpenAI (via OpenRouter) for the purpose of generating dream interpretations. No other personal data — including your name, email, date of birth, gender, occupation, or cultural background — is shared with these providers. See our Privacy Policy for full details. We are not responsible for third-party services beyond our reasonable control.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from loss of data, or that any AI-generated content will be accurate or suitable for your purposes.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Estonian or EU consumer protection law.

12. Limitation of Liability

To the maximum extent permitted by law, Dreamwarden OÜ and our directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for all claims arising out of or in connection with the Service in any twelve-month period shall not exceed the greater of (a) the amount you paid us for the Service in that period, or (b) fifty euros (€50).

Nothing in this section limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold Dreamwarden OÜ harmless from any claims, damages, losses, liabilities, and reasonable costs (including legal fees) arising out of or in connection with: (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) Your Content.

14. Termination

You may stop using the Service and delete your account at any time through the in-app settings or by contacting us at support@murkaverse.com.

We may suspend or terminate your access to the Service immediately, with or without notice, if you breach these Terms, if your continued use poses a risk to us or other users, or if required by law. Sections that by their nature should survive termination (including Sections 5.2 (final paragraph), 9, 11, 12, 13, 15, and 16) will survive.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Estonia, without regard to its conflict of laws rules. Disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Estonia.

If you are a consumer resident in the European Union, this choice of law and jurisdiction does not deprive you of the protection of the mandatory rules of consumer law in your country of residence. EU consumers may also access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

16. Changes to These Terms

We may update these Terms from time to time. Where a change is material, we will give reasonable notice through the app, by email, or by updating the "Last updated" date and posting a notice. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms. If you do not agree to the change, you may stop using the Service and close your account.

17. Miscellaneous

• Entire agreement. These Terms, together with the Privacy Policy and any platform terms that apply, constitute the entire agreement between you and Dreamwarden OÜ relating to the Service.
• No waiver. Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
• Severability. If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full effect.
• Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate or in connection with a corporate transaction.
